Bagabuyo writes demand letter to Emano

Opposition lawyer Atty. Rogelio Bagabuyo has now formally written a demand letter to Cagayan de Oro City Vice-Mayor Vicente Emano to “start serving the City of Cagayan de Oro as the presiding officer of the City Council effective today, June 2, 2008,” or face legal action in court.

He is also anticipating that Emano’s office to issue a reply to his letter within the prescribed 15-days pursuant to Section 5 paragraph (a) of Republic Act No. 6713.

But Emano yesterday sent his 50th excuse letter to the City Council saying that he could not attend the City Council Session and preside over its regular session as he has to “attend to equally important matters.”

The vice-mayor’s letter included a designation of his PaDayon Pilipno partymate City Councilor Reynaldo Advincula to act as presiding officer in his absence.

In his letter, Bagabuyo told Emano, the titular head of the PaDayon Pilipino, that a year and 18 days had already “come and gone since the last elections” but that the latter “have yet to honor and comply with your oath of office as the presiding officer of the City Council of the City of Cagayan de Oro.”

He said this citing Section 456 (1), Article II, in relation to Section 49 (1) Chapter III, Book III, both of the Local Government Code, Republic Act No. 7160, as amended.

“Never mind what you have promised during the last elections and/or what your cohorts have ill advised you, but our country has remained steadfast in the principle that ours is a government of laws and not of men!,” the lawyer’s letter reads.

When Emano took his was sworn into office, Bagabuyo said it is become an “undisputed fact” that he has made an “oath to serve the City of Cagayan de Oro as the Presiding Officer of the City Council of our city.”

As a voter, a taxpayer and a concerned citizen of the City of Cagayan de Oro, he thus “respectfully demands” that Emano start serving the City of Cagayan de Oro as the presiding officer of the City Council effective today, June 2, 2008.

“Otherwise, I shall be constrained to seek legal remedies, no matter how lonely, expensive or unpopular it may be, if only to compel you to honor your oath of office and save our democratic way of life,” he said.
