City Councilor Bacal drove car that killed 14-year old teener

A 14-year old minor was killed after he was hit by the vehicle driven by Cagayan de Oro First District City Councilor Alden Bacal at Upper Dagong, Carmen around 5:00 a.m. yesterday morning.
Victim Junrey Balingit was driving a bicycle around the area when Bacal’s maroon Toyota Revo with plate number KCJ-161 hit the teenager.
Bacal said the incident was an accident and that he was even trying to swerve his vehicle away from the teenager on the road.
What happened instead was that the teenager also tried to get off his way and swung his bicycle in the same direction as that of his vehicle, he said.
Still, this city councilor who heads the committee on tourism said he had some glasses of liquor when he was driving on his way home yesterday morning.
“I do not tell I lie. Yes, I drunk some liquor but I was still able to drive properly and I can even remember everything entirely,” he said in the dialect over dxIF Bombo Radyo yesterday.
He added that he is ready to face any charges that may be filed against him.
Bacal admitted that he immediately went to the house of Vice-Mayor Vicente Emano who he describes is a “second-father” to him.
Emano said he was surprised to see Bacal at his door, seeking for hugs and was rambling about how he figured in an accident that got a teenager killed.
He said Bacal kept on saying that he did not do anything to the teenager who died but at the same time still rambling incoherently.
This former city mayor and PaDayon Pilipno titular head said he immediately sent out a person to check what actually happened.
“Even if he is a partymate, this has to be investigated,” he said even as he admitted that he had Bacal immediately submit himself to the authorities and had the whole incident recorded in a police blotter.
Bacal is now under custody of Emano.
The Revised Penal Code under Art. 364 or Criminal Negligence provides that when a driver who is under the influence of liquor commits an accident and caused the death of another person, his penalty will include a fine of P200,000 fine and prision correccional in its medium and maximum periods.
In 2005, Congress passed a bill that imposes stiffer penalties for drunk drivers who accidentally killed a person on the road. It increased the fine and added the penalty of life imprisonment.
