10. The non-transfer of ownership in favor of the City Government of land acquired through purchased worth P93.3 Million exposed the city of possible risk in court litigation in the future. Likewise, land acquired through donation has not been recorded in the book.

At year-end, Land account reflected an increased balance of P224.458 Million. Again, it has been disclosed that during the year under audit, the city government still failed to implement corrective measures on the following deficiencies, in violations to the existing rules and regulations, thereby adversely affecting the reliability of the financial statements.

Transfer of the certificate of ownership of 190 parcel of titled land/or acquired through purchased by the City Government with a total area of 876,995.29 square meters worth P86.3 Million have not been made. These are still in the name of the former owners (Annex F);

Titling and transfer of ownership of 34 parcel of untitled land/lots acquired through purchased by the City Government, having a total area of 128,975 square meters worth P7.0Million have not been made, (Annex F) and;

Acquired 52 parcels of untitled land/lots through donation with a total area 511,383 square meters have not been recorded in the books for having no appraisal value, much more, the titling and transfer of ownership in the name of the City Government have not been made. (For details please refer to Annex F).

Under Philippine laws acquisition of land is not presumed, but has to be supported with a public document. Certificate of land title is the best evidence in proving ownership of land. Without it, the heirs who may be interested in getting back the land expose the City Government to the risk of court litigation.

Recommendations

Instruct the City Generals Services Officer and all involved officials for the immediate transfer of ownership on all acquired properties in the name of the City Government.

Record all acquired real properties through donation in the books of accounts.
