1. Barangay RPT and community tax shares amounting to P298,048.01 were not remitted within five (5) days following the end of each quarter.

Sec. 271 (d) of R.A. 7160 provides that “The share of each local government unit shall be released, without need of any further action, directly to the provincial, city, municipal or barangay treasurer, as the case may be, on a quarterly basis within five (5) days after the end of each quarter, and which shall not be subject to any lien or holdback that may be imposed by the National Government for whatever purpose.

The account Due to the LGU-Brgy. showed a balance of P298,048.01 in the financial statements at year-end. This amount pertained to 30% RPT barangay share which is not yet remitted to date to the barangay concerned.

Below is the CY 2004 quarterly balance of the Due to the LGU-Brgys. representing Barangay RPT and community tax shares:

1st Quarter - P 53,863.36

2nd Quarter - 428,439.64

3rd Quarter - 264,939.44

4th Quarter - 298,048.01

This condition is violative to the provision of Sec. 271 (d) R.A. 7160 on the automatic release of barangay share, mention above.

The management commented that they found it hard to comply with the provision of Sec. 271 (d) of R.A. 7160 particularly the required 5-day period except when the LGU implements fully the computerization program as promised by COA. However, they will always make it a point that whenever an information or data is made available a remittance of the concerned barangay will follow.

The other priority projects of the barangays could have been implemented had the barangay share on real property taxes been remitted regularly.

Recommendation

Cause the release of the barangay share on the proceeds of basic real property taxes in accordance with Section 271 (d) of R.A. 7160.
