Lawyer for accused cop questions filing of charges at CHR-10, RIAS-10

The legal counsel for one of the police officers charged with murder for the death of 30-year old Robert Martinez yesterday questioned the filing of separate cases against his client at the regional office of the Commission on Human Rights (CHR-10) and at the Philippine National Police Regional Internal Affairs Service (PNP-RIAS-10).

Atty. Noel “Bong” Vedad, the lawyer for accused PO2 Bangkula Manangkawal, said the filing of a separate complaint at the CHR-10 is not proper considering that it is not an “adjudicating body” or one that can actually decide on facts and issues of a particular case.

“It is a redundant complaint,” he told Gold Star Daily.

Also, Vedad explained that the filing of a separate administrative complaint against his client and that of PO3 Rommel Pontillas at the PNP-RIAS-10 violates a circular issued by the Department of Interior and Local Government (DILG).

When pressed on about this DILG circular, the lawyer answered that he will reveal it at the proper time.

Still, he added that the filing of such charges at these two government agencies is the prerogative and right of the complainants.

Manangkawal and Pontillas are members of the City Anti-Illegal Drugs Task Force (CAID-TF) who allegedly murdered Martinez , a Higaonon native healer from Isla de Oro this city, last Dec. 4 at Cosmopolitan Funeral Homes at Capistrano-Kalambaguhan.

The case has been investigated by the regional office of the National Bureau of Investigation (NBI-10) under Atty. Jose Justo Yap resulting to the formal filing of charges for murder against the two officers at the City Prosecutors Office last Wednesday.

City Prosecutor Fidel Macauyag has already issued a subpoena for the two officers to answer the murder charges within 10 days from receipt. Also, he has ordered the creation of a three-member panel to hold the preliminary investigation of the case.

Vedad disclosed that they have yet to receive a copy of the murder complaint filed by the victim’s family as well as Macauyag’s subpoena for his client.

Nevertheless, he said the creation of a panel of assistant city prosecutors is a “good move” on the part of Macauyag.

“This will ensure that there is an impartial investigation on this case and that it shall be decided upon its merits,” he said.

    Can you send me the transcript of the case thru my email, Im praying that the police officer and that martinez will be accorded a fair trial … and no buy out among the legal practitioners and all others who are involved, I will be praying for this case ..God bless
