Opposition to elevate Agora BOT contract to court

Opposition lawyer Rogelio Bagabuyo yesterday disclosed plans to meet with other opposition leaders and interested individuals to plan out the appropriate legal action to stop the implementation of the P255 million Build-Operate-Transfer (BOT) contract for the Agora Integrated Bus Terminal (IBT).
He said opposition city councilors Roger Abaday, Teodulfo Lao and Zaldy Ocon are already gearing up to obtain from the City Council in today’s regular session a legislative measure to put a halt to the above project.
“But if our opposition councilors are outvoted, then I am willing to meet with any interested party to map out the next appropriate legal action against this Agora BOT project,” he told Gold Star Daily.
Already, Abaday said he has already prepared a special report that will include at the very least a motion for the deferment of the implementation of the Agora IBT BOT project until all the requirements of Republic Act 7718 or the BOT law have been complied with by all concerned parties.
But Majority Floor Leader Atty. Ramon Tabor, who explained that City Council regular sessions have been moved to Tuesdays starting this month, said there will be no voting on the Agora BOT contract in their regular session today.
“I did not yet receive of the copy of the contract. So voting cannot as yet be conducted,” his text message to this paper reads.
Nevertheless, Tabor said the local opposition has every right to initiate legal action on any matter including that of the above project.
He admitted that, while pro-administration and opposition city councilors may have their say at the City Council, it will be the courts of law which will be the final arbiter.
“The courts upon hearing will decide who is right in a particular issue and upon exhausting all legal remedies allowed the party declared as wrong must abide by the decision. This is democracy at work,” he said.
