Detained communist leader seeks reinvestigation on charges

A detained senior member of the Communist Party of the Philippines in North Central Mindanao Region (CPP-NCMR) is seeking for a reinvestigation of the criminal charges lodged against him.

CPP-NCMR regional party committee secretary general Alfredo “Ka Paris” Mapano said this as the charges against him are fabricated.

“Walay basihanan kini tanan ilang gipasaka sa akoa (The criminal charges filed against me are without any basis),” he said.

Mapano’s lead counsel Atty. Frederico Gapuz explained that there are 12 criminal cases filed against his client in the trial courts in the provinces of Agusan del Sur, Bukidnon and Misamis Oriental.

However, he said the charges against Mapano and all the other respondents were elevated to these courts without even conducting preliminary investigations at the respective prosecutors’ offices which have jurisdiction in these areas.

“We are asking for a reinvestigation on these cases wherein no preliminary investigation was ever conducted which is one of the rights of my client,” he told Gold Star Daily.

He added that a reinvestigation would mean temporarily holding off the court trial until it could be ascertained that indeed there is enough evidence by the complainants to push the case at the court level.

Mapano is still languishing at the Misamis Oriental Provincial Jail (MOPJ) after being arrested in Middleton Appartelle, Barangay Carmen, Cagayan de Oro last August 1, 2009.

According to documents furnished to this paper, Mapano has criminal cases, for murder, frustrated murder, damage to property and robbery cases, at the Regional Trial Court (RTC)—Branch 17 under Judge Florencia Abbu with case docket number 2003-955.

This top-ranking communist leader is also facing two carnapping charges separately filed at RTC Branch 10 and RTC Branch 8 in Malaybalay, Bukidnon with Case No.17949-07 and 17752-07, respectively.

The bailbond recommended for the first carnapping is set at P180,000 while the second is at P300,000.

Also, filed against Mapano at RTC Branch 10 Malaybalay, Bukidnon court are charges of Attempted Murder under Case No.17753-07 with a bailbond of P300,000, Murder under Case No.17754-07 with no bailbond recommended and Robbery in Band under Case No.11755-07 with bailbond at P200,000.

Mapano is also being charged with Robbery under Case No.2968 and Robbery with Double Homicide and Damage to Properties under Case No.2252 all lodged at RTC Branch 7 in Bayugan, Agusan del Sur.

The rebel leader is also facing charges of Double Frustrated Murder under Case No.20162-09, Robbery under Case No. 20163-09 and Murder and Multiple frustrated murder under Case No. 15942-09 all to be tried at RTC Branch 8 in Malaybalay, Bukidnon.

Among the other respondents being charged together with Mapano on some of the above crimes are National Democratic Front – Northern Mindanao Region (NDF-NMR) head Jorge “Ka Oris” Madlos, Abelardo “Zorro/Tatay” Navarro, Romy “Bobet Boca” Menenio, Myrna “Emang” Sularte , Felix “Marco” Manliguez, Maria Luisa “Meriam/Nanal” Pucray, Dionisio “Kardo / Ka Moling” Micabalu, Rico “Jackrey” Genanas and “Armando “Dario” Daluniag among others.
