Ocon threatens to withdraw vice-mayoral bid

City Councilor Zaldy Ocon yesterday threatened to resign as Lakas-Kampi vice-mayoral candidate should evidence be presented that City Hall lands were sold for only P1.00 per parcel of land allegedly to help out the landless poor under the controversial Piso-Piso Land Resettlement Program.

The challenge was addressed to PaDayon Pilipino titular head and incumbent city vice-mayor Vicente “Dongkoy” Emano and other PaDayon Pilipino leaders who initiated this program as early as 1998.

“Ako silang gitagaan ug at least two weeks para makapakita ug usa ka Deed of Absolute Sale nga nakabutang ang presyo sa pagbaligya sa yuta kay piso lang…kung makapakita sila mo-withdraw ako dayon pagka-kandidato sa pagka-vice-mayor,” Ocon told reporters yesterday.

Ocon issued this challenge during their regular City Council session yesterday bringing with him bank documents including a lengthy mortgage document entered by the City Hall under Emano and the Development Bank of the Philippines (DBP).

He pointed out under the list of mortgaged land properties mortgaged are the land areas that are now being supposedly sold out by the then Emano administration to the landless indigents for P1.00 and currently being occupied by them being so-called Piso-Piso beneficiaries.

Ocon also pointed out portions of the document which provide stipulations that these Piso-Piso lands cannot be sold or in any way encumbered by the mortgagor City Government without the absolute consent of the mortgagee bank, DBP.

Because of this proviso, this opposition city councilor said it would have been impossible for the Emano Administration and its PaDayon Pilipino member-officers to have actually carried out the Piso-Piso Land Program and issued out Absolute Deed of Sale documents to the landless poor.

“Unya eleksyon nasab karon ug gahadlokon napud raba nila na nga kung dili mo-vote ibot,” he said.

Ocon said this is the reason why PaDayon Pilipino-aligned city councilors were mum during the entire length of his special report speech.

“Kay kabalo sila nga gailaron lang nila ang katawhan niini,” he said.

Nevertheless, PaDayon Pilipino leader City Councilor President Elipe brushed off Ocon’s challenge as being “easier said than done.”

But he clarified that they are not using the Piso-Piso Land Resettlement Program to threaten the residents of these Piso-Piso land properties to vote for them or face ejection from the land they are occupying.

“Wala pa maski isa nga gipapahawa nato diha sa atong mga resettlement land areas nga under sa atong Piso-Piso,” he said.

Still, the City Hall-DBP mortgage agreement contains stipulations that the mortgagee-bank DBP may “immediately foreclose the mortgage judicially or extrajudicially” under the law specifically Commonwealth Act No. 3135, as amended, or under Republic Act 85, as amended, and under Commonwealth Act No. 1508, as amended.

For the purpose of extrajudicial foreclosure or foreclosure without passing through the regular trial courts, the City Hall-DBP mortgage document contains an agreement that would allow the mortgagee-bank “to take charge of the mortgaged property at once and to hold possession of the same.”

The mortgage documents reveal that three City Government land properties were mortgaged by Emano in 1999 for P100 million under the “City Land Banking Project.”
